Delta-8, THCa & Hemp THC Payment Processing

Delta-8, THCa, and hemp THC businesses can still get payment processing, but only a small group of acquirers accept intoxicating hemp, and every one requires full product disclosure. The federal hemp redefinition takes effect in two stages, Nov 12 and Dec 11, 2026, and your product line has to be checked against both dates.

Intoxicating hemp is the hardest category we place among the high-risk industries we serve. Acquirer appetite was narrow before Congress rewrote the hemp definition, and it has narrowed further since. Canna Merchant Accounts, a division of Green Financial, works with the acquirers that still board this category and tells merchants plainly which products they will and will not accept.

Who this is for

This page covers merchants selling intoxicating hemp-derived cannabinoid products, online or in stores:

  • Delta-8, delta-10, and other converted cannabinoid products (vapes, edibles, tinctures)
  • THCa flower, pre-rolls, and concentrates
  • Hemp-derived delta-9 THC gummies, edibles, and beverages
  • Smoke shops, vape shops, CBD stores, and convenience retailers carrying any of the above
  • Brands and wholesalers manufacturing or distributing these products

If you sell only non-intoxicating CBD, your path is easier. See CBD merchant accounts. Smoke and vape shops with a mixed product line should also read smoke shop merchant accounts and vape shop merchant accounts.

The federal hemp redefinition: what applies on Nov 12 and Dec 11, 2026

Sec. 781 of Division B of Public Law 119-37, signed in November 2025, rewrote the definition of hemp in 7 U.S.C. 1639o. It was set to take full effect Nov 12, 2026. Sec. 2019 of H.R. 6500, the Continuing Appropriations and Extensions Act, 2027, signed in early September 2026, split that into two dates.

Hemp redefinition effective dates and products affected
DateWhat takes effectProducts affected
Nov 12, 2026Exclusion of cannabinoids not capable of being naturally produced by the cannabis plantFully synthetic cannabinoids such as THC-O acetate
Dec 11, 2026Exclusion of naturally occurring cannabinoids synthesized or manufactured outside the plantConverted cannabinoids, such as delta-8 made from CBD
Dec 11, 2026Total THC standard (THCa counts toward THC)THCa flower, pre-rolls, and concentrates that test above the limit once THCa is counted
Dec 11, 2026Cap of 0.4 mg total THC per container on finished productsHemp THC gummies, edibles, beverages, and full-spectrum products above 0.4 mg per container

The Dec 11 date lines up with the end of the stopgap funding period. After Dec 11, absent new law, the full redefinition applies. Several outlets reported that converted cannabinoids stay covered on Nov 12. Under the enacted text, only the “not capable of being naturally produced” category applies on Nov 12.

Two other items are still open. The FDA missed its Feb 10, 2026 deadline to publish its list of THC-class cannabinoids, which we covered in the FDA’s missed deadline. The Lawful Hemp Protection Act, introduced July 22, 2026 by Rep. Barr (R-KY) and Rep. Craig (D-MN), would set a 1% total THC dry-weight limit on finished products, a 21+ age requirement, packaging and labeling rules, FDA oversight, and a federal excise tax. It has not passed. For a deeper look at what the redefinition means for your processing, read delta-8 and THCa payment processing after the hemp redefinition.

Why acquirer appetite is narrow

Most acquirers that accept CBD exclude intoxicating hemp in their risk policy. The ones that accept it set tight conditions: a specific product list, age verification, and a reserve. Each date above forces those acquirers to re-review their portfolios, and products that fall outside the federal hemp definition will not stay on a card-processing account.

Full disclosure is mandatory

List every intoxicating product on your application, by cannabinoid and format. Approving a merchant as “CBD” and then finding delta-8 or THCa on the site is one of the most common reasons these accounts get terminated. Miscoded or disguised transactions risk termination and a MATCH listing, which follows you to the next processor.

State bans and restrictions

State law applies on top of federal law and runs on its own schedule. A product that is federally compliant can still be banned, age-restricted, or limited to licensed dispensaries in a given state. Acquirers expect you to block sales into states where your products are prohibited. Two examples:

  • California. AB 8, signed Oct 2, 2025, places intoxicating hemp cannabinoid products under the state’s cannabis framework and limits their sale to licensed cannabis dispensaries. Non-intoxicating CBD remains legal in general retail.
  • Texas. Department of State Health Services rules effective March 31, 2026 set a minimum purchase age of 21 for consumable hemp products and require pre-sale testing that counts THCa toward total THC.

Many other states ban or restrict delta-8 and similar products, and the list changes often. Check the current rules in every state you sell into before you apply, and keep a written state-by-state shipping policy. Underwriters ask for it.

What underwriters look for

  • Complete product list with cannabinoid, format, and THC content per serving and per container
  • Certificates of analysis from third-party labs, reporting total THC (delta-9 plus THCa) for each batch
  • Age verification at checkout and in store, with a 21+ gate on the website
  • Geo-restrictions that block shipping to states where your products are banned
  • Website compliance: no disease or medical claims, posted terms, refund, shipping, and privacy policies, and product pages that match the COAs
  • Processing history from prior accounts, if you have it, including dispute ratios
  • Business documents: formation documents, owner ID, a voided check or bank letter, and any state licenses or registrations
  • A plan for Dec 11: which SKUs you will drop, reformulate, or move, and when

Payment options available

Availability depends on the acquirer and your exact product mix. Options we can arrange include card processing through high-risk acquirers that accept your products, ACH and eCheck, retail POS with tap, chip, and swipe, mobile readers and virtual terminals, ecommerce gateway integrations for Shopify, WooCommerce, and other platforms, and chargeback and fraud tools on PCI-compliant infrastructure. Next-day funding is available on qualifying accounts. See our payment processing page for the full list.

Risks specific to this vertical

Terminations tied to regulatory dates. Expect acquirers to review hemp THC accounts around Nov 12 and Dec 11. Accounts selling products that fall outside the federal definition after those dates are at risk of closure.

Reserves. Rolling reserves are common on intoxicating hemp accounts. The acquirer sets the percentage and hold period at approval.

Undisclosed products. Adding a new cannabinoid or format without updating your processor is grounds for termination. Tell us before you launch it.

How our process works

  1. Apply. Submit the application on our payment processing page with your full product list and website URL.
  2. Underwriting review. We check each product against the federal dates, your state restrictions, and the acquirer’s policy, then tell you which SKUs it will accept.
  3. Approval and setup. Once approved, we configure your gateway or POS, age verification, and funding schedule, and confirm reserve terms in writing.
  4. Go live. You process with one point of contact. When the rules change, we review your account and product list with you.

Funding and banking

Hemp businesses facing reformulation or inventory write-downs often need working capital. Our business funding program includes lines of credit, merchant cash advance, invoice and AR financing, asset-based lending, and equipment financing. We do not offer bank accounts directly. Through our business banking program we connect you with cannabis-friendly partner banks and coordinate the initial vetting and paperwork.

Frequently asked questions

Can I get a merchant account for delta-8 products?

Some high-risk acquirers accept delta-8 with full product disclosure, age verification, and state shipping restrictions. Under the federal redefinition, converted cannabinoids such as delta-8 made from CBD fall outside the hemp definition on Dec 11, 2026, absent new law.

Is THCa flower still legal to sell after the hemp redefinition?

The redefinition counts THCa toward total THC starting Dec 11, 2026. THCa flower that tests above the total THC limit once THCa is counted will not meet the federal hemp definition after that date, absent new law.

What changes on Nov 12, 2026 for hemp products?

Only the exclusion of cannabinoids not capable of being naturally produced by the cannabis plant takes effect on Nov 12. That covers fully synthetic cannabinoids such as THC-O. The total THC standard, the 0.4 mg per container cap, and the exclusion of converted cannabinoids take effect Dec 11, 2026.

Can hemp THC beverages and gummies accept credit cards?

Some acquirers accept them today with full disclosure. Starting Dec 11, 2026, absent new law, finished products above 0.4 mg total THC per container fall outside the federal hemp definition, and acquirers will review accounts accordingly.

Do I have to tell my processor I sell delta-8 or THCa?

Yes. Every intoxicating product must be disclosed on the application and before you add it later. Undisclosed products are a leading cause of termination and can lead to a MATCH listing.

Which states ban delta-8 and intoxicating hemp?

The list changes often. California limits intoxicating hemp products to licensed cannabis dispensaries under AB 8, and Texas set a 21+ purchase age for consumable hemp in rules effective March 31, 2026. Check current law in each state you sell into.
