Vape Shop Merchant Accounts
Vape shops and online vape retailers can accept credit and debit cards through a high-risk merchant account. In-store shops need state licensing, age checks and a disclosed product list; online sellers also need PACT Act registration, age verification at checkout and delivery, state tax compliance, and a shipping method other than USPS.

This page is part of our high-risk industries we serve. It covers vape shop credit card processing for retail counters, e-liquid payment processing for online stores and brands, and shops selling hemp vape hardware. Smoke shops and glass shops with only a small vape section should also read our smoke shop merchant account page.
Who this page is for
Retail vape shops
Counter sales of disposables, pods, devices, coils and e-liquid.
Online vape retailers
Ecommerce stores shipping nicotine products to consumers, which puts them under the PACT Act.
E-liquid brands and wholesalers
Manufacturers and distributors selling to shops by invoice, ACH or card.
Hemp vape sellers
Cartridges, disposables and batteries for CBD or hemp THC products.
Why vape is a high-risk category
Mainstream processors restrict it. Stripe’s restricted business list includes “Tobacco products, including e-cigarettes,” which means extra review and approval before a vape store can process, and many vape accounts on self-serve platforms get closed once that review happens. A vape merchant account built for the category starts with the regulatory questions an acquirer will ask, so they are answered before approval instead of after.
FDA marketing authorization
Under the Federal Food, Drug, and Cosmetic Act, a new e-cigarette product needs FDA marketing authorization, usually through a premarket tobacco product application (PMTA). FDA’s published list of authorized e-cigarettes (last updated May 2026) includes products from five companies: Glas, JUUL, Logic, NJOY and Vuse. FDA describes them as “the only e-cigarettes that may be lawfully sold in the United States.” FDA authorized additional Juul2 products in late August 2026, and trade press now counts 48 authorized e-cigarette products. Most products on the list are tobacco or menthol varieties.
In April 2025 the Supreme Court upheld FDA’s authority to deny marketing applications for flavored e-liquids. DOJ and FDA run a joint task force on illegal e-cigarette distribution, and in September 2025 brought civil actions against distributors and retailers in six states, with one warehouse seizure of more than 600,000 units.
States have added their own layer. A growing number of states now operate vapor product directories, and retailers there can only sell products the manufacturer has certified and listed with the state.
Expect the acquirer to compare your product list against what can be legally sold. Disposables with no FDA authorization and no state directory listing are the products most likely to cause a decline or a later termination. Know which of your SKUs are authorized or listed, and be ready to say so.
The PACT Act and online vape sales
Since the Preventing Online Sales of E-Cigarettes to Children Act took effect in 2021, the PACT Act treats electronic nicotine delivery systems as cigarettes for delivery sales. The federal ENDS definition covers any electronic device that delivers “nicotine, flavor, or any other substance” to a user inhaling from it, plus components, liquids, parts and accessories sold separately. E-liquid, pods, coils and hemp vape hardware are all inside it.
| Requirement | What it means in practice |
|---|---|
| Registration | Register with the U.S. Attorney General (administered by ATF) and with the tobacco tax administrator of each state you ship into, before you ship. |
| Monthly reports | By the 10th of each month, report the prior month’s shipments into each state: customer name and address, brand, quantity and carrier. |
| State and local law | Pay excise taxes and follow the licensing, tax stamp and minimum age laws of the delivery address, as if you sold there in person. |
| Age check at checkout | Verify the buyer’s full name, birth date and address against a commercially available database built mainly from government records. |
| Age check at delivery | Use a delivery method that requires an adult of legal age to sign and show government-issued photo ID. |
| Labeling and weight | Mark the package with the required federal statement, and keep each sale or delivery at 10 pounds or less. |
| Records | Keep delivery sale records by state, city and zip code for enforcement officials. |
The Attorney General keeps a list of noncompliant delivery sellers, and carriers are not supposed to deliver for sellers on it. Our longer guide covers PACT Act compliance and payment processing for vape shops step by step.
Under the USPS final rule effective October 21, 2021, vape products, including components, liquids, parts and accessories, are nonmailable except for narrow exceptions: intrastate shipments within Alaska or Hawaii, verified business-to-business or regulatory shipments, and limited noncommercial shipments by adults. UPS and FedEx also announced in 2021 that they would stop delivering vape products to consumers. Confirm your carrier’s current terms in writing before you apply.
Hemp vapes
Hemp cartridges and disposables sit in two rule sets at once. The hardware falls under the ENDS definition, so PACT Act and USPS rules apply to shipping it. The oil inside falls under the federal hemp redefinition in Public Law 119-37: synthetic cannabinoids such as THC-O and HHC-type compounds drop out of the hemp definition on November 12, 2026, and the total THC standard and 0.4 mg per container cap reach delta-8 and other converted cannabinoids on December 11, 2026. See hemp THC payment processing for how acquirers are handling those dates.
What underwriters look for
Every application gets a pre-review before it goes to an acquirer: posted refund, privacy, shipping and terms policies, lab results where they apply, and current licensing. The banks behind the acquirer expect to see the same in place.
- Formation documents, owner IDs, and beneficial ownership for each owner at 25% or more
- State and local tobacco or vape retail licenses for every location
- A full product list by SKU, with FDA authorization or state directory status where you know it
- COAs for any hemp vape products
- Three to six months of bank and processing statements if you have them
- For online sales: PACT Act registrations, sample monthly reports, your age verification provider, and your carrier and adult-signature delivery method
- A website with an age gate and product descriptions that make no health or cessation claims
Payment options for vape shops
In-store POS
Tap, chip and swipe terminals, plus mobile readers for events.

Risks specific to vape merchants
Online vape chargebacks come from failed adult-signature deliveries, returned packages and “not authorized” disputes. Clean age verification records are your best evidence in a dispute. High-risk vape accounts may carry a rolling reserve; read how rolling reserves work and our guide to chargeback thresholds before you sign. Undisclosed products, especially unauthorized disposables and hemp THC carts, remain the leading cause of termination in this vertical.

Vape shop merchant account FAQ
Can a vape shop accept credit cards?
Yes. Vape shops can accept credit and debit cards through a high-risk merchant account underwritten for nicotine products. Online sellers also need to show PACT Act registration, age verification and a compliant shipping method.
Does Stripe allow vape shops?
Stripe lists tobacco products, including e-cigarettes, as a restricted business that needs extra review and approval. Many vape merchants find their self-serve accounts closed after that review, which is why they move to a high-risk merchant account.
Does the PACT Act apply to online vape sales?
Yes. Since 2021 the PACT Act covers electronic nicotine delivery systems, including e-liquid, parts and accessories. Online sellers must register, file monthly state reports, pay state and local taxes, verify age at checkout and delivery, and label packages.
Can I ship vapes through USPS?
Not to consumers. Since October 21, 2021 vape products are nonmailable except for narrow exceptions such as intrastate shipments within Alaska or Hawaii, verified business-to-business shipments, and limited noncommercial shipments by adults.
Can I process payments for disposables without FDA authorization?
FDA says only authorized e-cigarettes may be lawfully sold in the United States, and many states now limit sales to products listed in a state directory. Acquirers review product lists for this, and unauthorized disposables are a common reason for decline or termination.
Does the PACT Act apply to CBD or delta-8 vape carts?
The federal ENDS definition covers devices that deliver nicotine, flavor or any other substance, plus their components and liquids. Hemp vape hardware falls inside it, and USPS treats it as a nonmailable vape product.
What do I need for e-liquid payment processing?
Formation documents, owner IDs, licenses, a full SKU list, bank and processing statements, posted store policies, and for online sales your PACT Act registrations, age verification provider and adult-signature carrier.
